The Act also introduced the concept that children are victims in their own right: Part 1 of the Act, which lays out the new Statutory Definition of Domestic Abuse, provides that a child who sees or hears, or experiences the effects of, domestic abuse and is related to the person being abused or the perpetrator is also to be regarded as a victim of domestic abuse. The Act also recognises the ongoing impact of domestic abuse post-separation, which is often exercised via child contact arrangements and via the family courts, and will extend the controlling or coercive behaviour offence to cover post-separation abuse. |
